We are conscious of the great importance of your personal data protection. This Privacy policy applies to our websites www.customsclear.net and www.customsclear.ai, including the AI-powered assistants available at www.customsclear.ai. We collect and process only the data that is necessary for the performance of our activities. We process personal data in a legitimate, transparent and fair manner, for pre-defined purposes and only to the extent necessary for the achievement of the purposes of the processing. When processing personal data, we want it to be accurate, safe, confidential, duly stored and protected.

Your personal data is managed from our residence country, i.e. the Republic of Lithuania. Your personal data is managed in accordance with the General Data Protection Regulation (EU) 2016/679 adopted on 27 April 2016 (the "GDPR"), as well as the requirements for managing personal data as set in other applicable legal acts.

After reading this privacy policy (the “Privacy policy”) you will know how and why we process your personal data, how we receive your personal data, to whom we provide it, how we store your personal data and what your rights are as the data subject. "Data subject" refers to any natural person who can be identified, directly or indirectly, via identification information (i.e. personal data).

The Privacy policy sets out privacy conditions regarding your personal data processing and our privacy rules applied in our activities with respect to the use of our website, i.e. the platform www.customsclear..net (the “Platform”), and/or our accounts on social networks as regards personal data processing and our privacy rules applied in our activities. Please read the Privacy policy carefully, as each time you visit our Platform and/or our social network accounts, you accept the conditions of this Privacy policy. If you do not accept these terms and conditions, please do not visit our Platform and/or our accounts.

The Privacy policy also applies to anyone visiting the Platform and/or our social network accounts, as well as to actions that might have been performed on the Platform and/or our social network accounts, including the review of content, submission of enquiries, writing of comments, etc.

We recognise the privacy interests of children and encourage parents and guardians to take an active role in their children’s online activities and interests. Children should not use our services. If we learn that we have collected personal data from a child, we will take reasonable steps to delete it. Parents and guardians who believe that we may have collected personal data from a child can submit a request for its removal to us.

The definition “personal data” used in this Privacy policy refers to any information that allows us to identify you – to establish your identity directly or indirectly. Personal data might include (for example) first name, last name, email address, telephone number, location data, online identifiers, characteristics, and any other personal data, as specified in the GDPR.

Why and how do we process your personal data?

We may process your personal data for the purposes indicated in this section of the Privacy Policy. Each purpose of personal data processing is individual and separate. If you have any questions regarding which specific personal data we process about you, please feel free to contact us by exercising your rights as outlined in Section 12 of the Privacy Policy.

For the purpose of direct marketing. We process your personal data upon receiving your consent, in order to provide you with newsletters. The content of the newsletters depends on your selected preferences and may include updates about us, course providers, publishers, or our other partners; our offers and information on our goods and/or services, or those of related parties and partners; events or other relevant information; and to help improve our services. For this purpose, we may process personal data such as your login name, email address, first name and last name (if these form part of your email address), chosen subscription frequency (e.g. weekly, monthly), and content preferences (e.g. topics, geography, languages). This data is received directly from you. Your personal data may be transferred to legal entities providing platform maintenance, IT services, or marketing services. For the purpose of quality control and ensuring functionality of the Platform and/or our social network accounts. This includes processing your submitted enquiries, complaints, comments, and communication (including storage). When you contact us (or we contact you in response to your enquiry), we process information received via phone, email, the Platform and/or our social network accounts, or any other communication method. This data helps us respond and investigate your query or concern in line with this Privacy Policy. Personal data may include your first and last name, email address, IP address, nickname, related company, phone number, complaint or enquiry content, date and time of contact, and communication records. Data may be collected directly from you or generated during our handling of your enquiry or complaint. For example, we may contact third parties to verify facts and record that information. This data may be transferred to legal entities providing website maintenance and IT services. It is stored for 1 year from the date of recording, unless there are grounds to believe a crime or unlawful act has been committed, or an internal investigation is ongoing. In such cases, data is kept until the investigation or related legal process concludes.

To improve the Platform and offer better, more customised services. Your personal data, including that collected via the Platform and/or our social network accounts, is used to improve and develop the Platform and provide you with enhanced, tailored services. Cookies help us collect this data, as described in Section 7 of this Privacy Policy. We use data you provide, data generated through your use of the Platform, and data received from other parties (e.g. social network operators). For further details on our use of cookies and similar technologies, see Section 7.

For the purpose of managing the user account and providing our services. To access our services (e.g. reading articles, watching videos, taking quizzes, receiving certificates), you must create or update a User account and profile. We collect and store data across the following profile sections:

  • Personal information: full name (first name, last name, or other submitted name), profile picture (optional), country (optional), industry details (optional), other optional information you provide.

  • Account/password: email, password.

  • Payment methods: name on credit card, card number, expiry date, billing country, address, phone number, company/organisation codes (optional)

  • Preferences for personalisation purposes: languages spoken, markets of interest, and other.

  • My video courses: courses in progress, completed courses with certificates, saved or assigned courses.

  • My articles and journals: usage history, saved items, subscription plan, purchased items, purchase history (product name, date, price, payment method, invoice details).

  • Account activity: date of account creation, updates, and deactivation.

Parts of your profile (e.g. name, picture, country, industry information) may be visible to others.

We use personal data received directly from you, generated through your use of the Platform, or received from others (e.g. course providers, publishers, banks, payment institutions, employers).

This data may be transferred to legal entities providing IT or legal services.

For the purpose of content publishing. We may process creators' personal data such as first name, last name, and professional experience descriptions. This data may be obtained directly from creators or through course providers/publishers. Data may be transferred to legal entities providing platform maintenance or IT services. It is stored for the duration specified in the agreement between the creator and the course provider/publisher.

For other purposes. We may process your personal data where required by law, in pursuit of our legitimate interests, or based on other legal grounds provided for under applicable legislation.

How is this Privacy policy updated?

Any updates to our Privacy policy will be published on the Platform. Where necessary, we will notify you of any changes. New terms and conditions of the Privacy policy may also be displayed on the Platform, and you may be required to read and accept them in order to continue using the Platform and/or our services.

How do we share your personal data?

We guarantee that your personal data will not be sold, supplied, or otherwise shared with third parties without legitimate grounds, nor used for purposes other than those for which it was collected. We will not transfer your personal data in any way other than in accordance with this Privacy policy and/or other internal documents and legal regulations. Do we use your personal data for direct marketing and what are the rules for subscription to our newsletters?

Please note that withdrawing consent does not automatically result in the deletion of your personal data or the provision of information about the data we process. If you would like us to take these additional steps, please submit a separate request.

How long do we store your personal data?

We retain your personal data only for as long as necessary to fulfil the purposes of its processing, or as required by law if a longer retention period is prescribed.

We aim not to store outdated or irrelevant personal data. Therefore, when data is updated (e.g. amended or changed), only the latest relevant information is retained. Historical data is stored only where required by law or necessary for the performance of our activities.

Where can you submit a complaint?

How do we collect your personal data?

We process your personal data received through the following methods:

You provide us with your personal data and other information by using the Platform and/or our social network accounts through your active engagement, e.g. by writing to us or communicating with our team, submitting complaints and/or enquiries, assignments, comments, creating your own profile, etc. Please note that if you contact us in writing or by e-mail, we may store the correspondence data.

  • When you use our Platform and/or our social network accounts. When you use our controlled Platform and/or our social network accounts, certain information (e.g. IP address, type of browser used, year, number of visits, reviewed pages, time spent on the Platform, referring website, device information, language, country, internet service provider, etc.) is collected automatically.

  • When we receive your personal data from other persons in accordance with legal procedures and/or this Privacy policy.

How do we store your personal data?

Data collected from you will primarily be stored within the European Union (EU), but may also be transferred to or stored in countries outside the EU. Your data may also be processed by our personnel or the personnel of our partners located outside the EU. When you provide us with your personal data (each time you use our Platform and/or our social network accounts), or we collect or obtain your personal data from other sources, we become the controllers of your personal data and process it for the purposes indicated in this Privacy policy. You have the right to exercise your rights (as set out in the GDPR) in respect of us.

What are your rights?

When we process your personal data, we ensure your rights under the General Data Protection Regulation (GDPR) and the Law on the Legal Protection of Personal Data of the Republic of Lithuania. As a data subject, you have the following rights:

To be informed about the processing of your personal data.

  • To access your personal data held by us.

  • To request rectification, clarification, or completion of inaccurate, incorrect or incomplete personal data.

  • To request the erasure of your personal data when it is no longer necessary for the purposes for which it was collected.

  • To request the erasure of your personal data if it has been processed unlawfully, or if you withdraw consent or did not provide consent where it was required.

  • To object to the processing of your personal data or withdraw previously given consent.

  • To request that we suspend the processing of your personal data (except for storage) during disputes, or when you require verification of the legality or accuracy of the data, or in other cases where we no longer require your data, but you do not wish it to be deleted.

  • To request that your personal data, where technically feasible, be provided in an easily readable format or transferred to another data controller if collected based on your consent or a contract.

We will strive to uphold your rights as a data subject and provide the conditions necessary for their effective exercise. However, we reserve the right to decline certain requests when necessary to ensure:

You may submit requests regarding your data subject rights via post email info@customsclear.net. Upon receiving your application, we may ask for proof of identity and any other information required to process your request.

We will respond to your request no later than 30 calendar days after receiving both your application and the necessary supporting documents.

If we consider it necessary, we may suspend the processing of your data (excluding storage) until a decision is reached regarding your request. If you withdraw your consent in accordance with legal requirements, we will stop processing your personal data without delay, and no later than within 30 calendar days – except in the circumstances outlined in this Section or where legal obligations, court decisions, or binding instructions require us to continue processing your data.

If we are unable to fulfil your request, we will clearly explain the reasons for our refusal.

If you disagree with our decision or with the way we have handled your application, you can appeal our actions and decisions by applying to the competent state authority.
